1. Acceptance of Terms
By engaging the services of Seven Bridges Property Management, LLC ("Company," "we," "us," or "our"), including Home Watch inspections, general maintenance, and Home Improvement Contractor (HIC) project work, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.
2. Services Offered
Seven Bridges Property Management, LLC provides property stewardship and maintenance services organized into the following tiers:
2.1 Tier 1: Home Watch (Peace of Mind Inspection)
2.2 Tier 2: General Maintenance (Preservation Package)
2.3 Tier 3: HIC Projects (Professional Scope)
3. Service Agreements and Contracts

All services are subject to a signed Service Agreement specific to the tier and scope of work.

Home Watch services (Tier 1) are provided under annual subscription agreements with monthly billing.

General Maintenance (Tier 2) work is performed under hourly or flat-rate agreements.

HIC Projects (Tier 3) exceeding $1,000 require a written contract compliant with Massachusetts General Laws Chapter 142A (M.G.L. c. 142A), including all required homeowner notices and references to the Home Improvement Contractor Guaranty Fund.

All HIC contracts will include specific language regarding the homeowner's rights and arbitration provisions as required by law.
4. Payment Terms

Home Watch (Tier 1): Billed monthly in advance. Payment is due upon receipt of invoice.

General Maintenance (Tier 2): Payment is due upon completion of work unless otherwise agreed.

HIC Projects (Tier 3): Payment terms will be specified in the project contract and may include a deposit, progress payments, and a final payment upon completion.

We accept major credit cards, debit cards, checks, and electronic transfers.

Late payments may be subject to a late fee of 1.5% per month on the outstanding balance.

You authorize us to charge your payment method on file for recurring services.
5. Client Responsibilities
As a client, you agree to:

Provide accurate and complete information about your property, including access credentials, alarm codes, and relevant system details

Notify us promptly of any changes to property access, ownership, or insurance coverage

Maintain adequate homeowner's insurance coverage for the duration of our service relationship

Provide a safe working environment at the property for our staff and subcontractors

Communicate any known hazards, environmental concerns, or special conditions at the property

Review and respond to inspection reports and service recommendations in a timely manner

Authorize work in advance as required under your Service Agreement
6. Property Access and Keyholding

Clients must provide reliable means of property access (keys, codes, smart locks) for the performance of services.

Seven Bridges Property Management, LLC will maintain secure storage and handling of all keys and access devices.

We will not duplicate or share keys or access credentials except as necessary to perform authorized services.

Upon termination of services, all keys and access devices will be returned to the client.
7. Inspection Reports and Documentation

Home Watch inspection reports will be delivered digitally via our secure client portal after each visit.

Reports include timestamped, high-resolution photographs and detailed findings.

Reports are provided for informational purposes and do not constitute a professional home inspection or engineering assessment.

Clients are responsible for reviewing reports and acting on any recommendations or identified issues.
8. Subcontractors
For work requiring specialized trades (licensed plumbing, electrical, etc.), Seven Bridges Property Management, LLC may engage licensed subcontractors. We will coordinate and oversee subcontractor work on your behalf. Subcontractors are independently licensed and insured. A management fee (typically 10–20%) may apply for subcontractor coordination.
9. Liability and Indemnification

Seven Bridges Property Management, LLC maintains General Liability insurance and specialized "Care, Custody, and Control" insurance for client property.

Our liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

We are not liable for pre-existing conditions, normal wear and tear, acts of nature, or damage caused by third parties.

You agree to indemnify and hold harmless Seven Bridges Property Management, LLC, its owner, employees, and agents from claims arising from inaccurate information you provide or hazards you fail to disclose.

Nothing in these Terms limits liability that cannot be legally excluded.
10. Insurance
Seven Bridges Property Management, LLC maintains the following insurance coverage:

General Liability Insurance

Care, Custody, and Control Insurance (for client property in our care)

Commercial Auto Insurance
-
Workers' Compensation Insurance (as applicable)
Proof of insurance is available upon request.
11. HIC Regulatory Compliance
Seven Bridges Property Management, LLC is a registered Home Improvement Contractor in the Commonwealth of Massachusetts. All HIC project work will be performed in strict compliance with M.G.L. c. 142A, including:

Written contracts for all work exceeding $1,000

Required notices regarding homeowner's rights

Contributions to the Home Improvement Contractor Guaranty Fund

Compliance with all applicable building codes, permits, and inspection requirements
12. Termination

Home Watch (Tier 1): Either party may terminate the annual subscription with 30 days' written notice. Prepaid fees for unused months will be refunded on a prorated basis.

General Maintenance (Tier 2): Either party may discontinue services at any time. Payment is due for all work completed.

HIC Projects (Tier 3): Termination of project contracts will be governed by the terms of the individual project contract and applicable Massachusetts law.

Upon termination, all keys and access devices will be returned, and any outstanding balances must be settled.
13. Intellectual Property
All content on our website and marketing materials, including text, graphics, logos, inspection report formats, and proprietary checklists, is the property of Seven Bridges Property Management, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written consent.
14. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and property information. Please review our Privacy Policy for more details.
15. Dispute Resolution
In the event of a dispute arising from these Terms and Conditions or our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes may be submitted to mediation or arbitration in accordance with Massachusetts law. For HIC projects, homeowners may also file a claim with the Home Improvement Contractor Guaranty Fund as provided under M.G.L. c. 142A.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Berkshire County, Massachusetts.
17. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Changes to These Terms
Seven Bridges Property Management, LLC reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with a revised "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the updated terms.
